Terms and Conditions

Welcome to LocalPets. These Terms and Conditions regulate access to and use of the LocalPets platform, including the websites localpets.co and localpet.co, as well as any related service offered by LocalPets.

By creating an account or using the platform, you agree to comply with these Terms and Conditions. If you do not agree with them, you must not use the platform.

You accept these Terms by ticking the corresponding box when you create your account. We keep the date and the version you accepted.

The Community rules (localpets.co/rules) are part of these Terms.

LocalPets is intended for people over the age of 18 who wish to connect with other community members to exchange pet care and accommodation voluntarily.

LocalPets is a platform that connects pet owners with sitters who wish to stay temporarily in a home while taking care of the owner’s pets.

LocalPets facilitates contact between both parties, but does not participate in the agreements reached between users and does not act as an employer, placement agency, insurer, financial intermediary, or veterinary service provider.

LocalPets is a brand operated by Miadels LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States.

The platform is available to users from different countries and offers these Terms in Spanish and in English. In case of any discrepancy, the version in the language in which you accepted them prevails.

To use LocalPets, you must:

• Be at least 18 years old.
• Have the legal capacity to accept these Terms and Conditions.
• Provide truthful and up-to-date information during the registration process.
• Keep your access credentials secure.

Each person may maintain only one active account on the platform.

It is not permitted to create duplicate accounts, use false identities, or register on behalf of another person without authorization.

LocalPets reserves the right to suspend or delete accounts that violate these rules.

LocalPets offers two main types of account:

• Owners: may create profiles, publish sits, introduce their pets, and select sitters for their homes.
• Sitters: may create personal profiles, apply for sits, and take care of pets during the periods agreed with owners.

Owners are responsible for the accuracy of the information published about their home, pets, and care requirements.

Sitters may submit applications to multiple sits simultaneously.

The acceptance of a sit does not create any employment, contractual, or labor relationship between the owner and the sitter.

To create an account on LocalPets, users must verify a valid email address.

Additionally, LocalPets carries out manual profile verification processes. Users who successfully complete this process receive a verification badge on their profile.

Account verification does not constitute a guarantee regarding the identity, behavior, reliability, experience, or suitability of any user.

LocalPets reserves the right to grant, deny, remove, or review any verification status at any time.

Users are responsible for all information, photographs, descriptions, and content they publish on the platform.

By publishing content on LocalPets, the user declares that:

• They have the necessary rights over such content.
• The information provided is truthful and not misleading.
• The content does not infringe third-party rights.
• The content does not contain illegal, offensive, fraudulent, or inappropriate material.

LocalPets may review, hide, or remove content that it considers contrary to these Terms, applicable law, or the proper functioning of the community.

Users keep ownership of the content they publish (texts and photos of their home, their pets and themselves). By publishing it, they grant Miadels LLC a non-exclusive, free, worldwide permission to:

• Store it, adapt it (for example, crop or resize a photo) and show it within LocalPets, on their profile, listings and reviews.
• Translate it and correct its spelling automatically.
• Share open or confirmed stays on the official LocalPets channels, including the Instagram account @elviajederita, to make them known to the community.

LocalPets will not use this content in paid ads and will not transfer or sell it to third parties. If you do not want one of your stays to be shared on social media, or want a post removed, write to support@localpets.co and we will remove it.

This permission ends when you delete the content or your account, except for reviews already published about other users and social media posts you have not yet asked us to remove.

Owners may publish sits indicating, among other aspects:

• General location of the home.
• Expected dates.
• Information about the pets.
• Care requirements.
• Relevant house rules.

Owners are responsible for keeping the information about their sits up to date and for communicating any relevant change to interested sitters.

LocalPets does not guarantee that a sit will receive applications or that an owner will find a suitable sitter.

Sitters may submit applications for sits they consider to be of interest.

Sitters may maintain multiple active applications simultaneously.

The final decision regarding the selection of a sitter belongs exclusively to the owner.

A sit shall be considered confirmed when the owner and the sitter have clearly expressed their agreement through the platform or by other communication means agreed between both parties.

LocalPets does not participate in the negotiation of the specific conditions of each sit and does not guarantee the effective completion of any agreement reached between users.

LocalPets may provide communication tools within the platform to facilitate contact between owners and sitters.

Users are free to exchange contact information and continue their conversations outside the platform if they wish.

Users are responsible for the communications and agreements they maintain with each other.

LocalPets does not permanently monitor all conversations between users and assumes no responsibility for the content of such communications.

All interactions are expected to take place in a respectful, honest manner and in accordance with the values of the community.

Owners and sitters may cancel a sit at any time.

However, cancellations may affect the experience of other community members and should be made as far in advance as possible when circumstances allow.

LocalPets does not guarantee alternatives, replacements, or relocations in the event of a sit cancellation.

Cancellations will be reflected in the history and reputation of users within the platform.

LocalPets reserves the right to review, limit, or suspend accounts that show a pattern of repeated cancellations, unreliable behavior, or conduct that negatively affects the community.

After the completion of a sit, owners and sitters may leave reviews and ratings about their experience.

Reviews must reflect real experiences and be written honestly and respectfully.

It is not permitted to:

• Publish false or misleading information.
• Use reviews to harass, threaten, or harm other users.
• Publish offensive, discriminatory, or illegal content.

LocalPets may moderate, hide, or remove reviews that violate these rules.

Reviews are part of the community reputation system and may influence the trust that other users place in a profile.

Owners are responsible for providing truthful, complete, and up-to-date information about:

• Their pets.
• Their home.
• The expected care tasks.
• The relevant house rules.

Owners must inform about any known medical condition, aggressive behavior, special need, or relevant circumstance related to their pets.

They must also provide reasonable information to manage emergency situations, including a contact method and the details of their trusted veterinarian.

Owners are responsible for ensuring that they have the necessary rights to offer their home and organize a sit through the platform.

Sitters undertake to act responsibly, respectfully, and in good faith during the sits they accept.

Sitters must:

• Follow the reasonable instructions provided by the owner.
• Take care of the pets diligently.
• Respect the home and the house rules.
• Inform the owner of any relevant incident that may affect the sit.

Sitters must not assume tasks that have not been previously agreed with the owner.

The acceptance of a sit implies the commitment to carry out the agreed care during the established period, except in exceptional circumstances.

Owners are responsible for providing sufficient information for the care of their pets during the sit.

In case of emergency, the sitter must try to contact the owner using the means provided and follow the reasonably available instructions.

LocalPets does not provide veterinary services and does not participate in decisions related to medical treatments for animals.

Unless there is clear evidence of gross negligence or intentional conduct by the sitter, veterinary expenses arising from the care of a pet shall remain the responsibility of the owner.

LocalPets assumes no responsibility for illnesses, injuries, accidents, loss, or death of pets that may occur during a sit.

LocalPets may grant a Founder Member badge to certain users who meet the criteria established by the platform.

Unless expressly indicated otherwise, the Founder Member badge will be limited to the first 500 users who complete the requirements defined by LocalPets.

The granting of this badge is discretionary and may be subject to review or verification processes.

The badge has an identifying and community-related purpose, and does not constitute a guarantee of behavior, experience, or quality by the user who holds it.

LocalPets reserves the right to modify, suspend, or terminate this program at any time.

Users undertake to use LocalPets responsibly and respectfully.

It is prohibited to:

• Provide false or misleading information.
• Impersonate another person.
• Create multiple accounts to avoid restrictions or sanctions.
• Use the platform for illegal activities.
• Publish offensive, discriminatory, threatening, or abusive content.
• Send spam or unsolicited communications.
• Manipulate the review or reputation system.
• Attempt to access accounts, systems, or third-party data without authorization.
• Use the platform in a way that harms other users or the community.

LocalPets may investigate any conduct it considers contrary to these Terms and adopt the measures it considers appropriate.

LocalPets may temporarily suspend or permanently close an account when it reasonably considers that a user:

• Has violated these Terms and Conditions.
• Has provided false information.
• Has carried out fraudulent activities.
• Has received multiple substantiated reports from other users.
• Has shown a pattern of behavior harmful to the community.
• Has compromised the security or integrity of the platform.

The suspension or deletion of an account may be carried out without prior notice when necessary to protect the community or the platform.

LocalPets, its trademarks, logos, design, interface, functionalities, texts, and other elements of the platform are the property of Miadels LLC or their respective owners.

No user acquires intellectual property rights over the platform by using it.

Users may not copy, reproduce, distribute, modify, or commercially exploit elements of LocalPets without prior written authorization.

LocalPets does not guarantee:

• That the platform will be available without interruption.
• That any user will find a suitable sit.
• That any owner will find a suitable sitter.
• Compatibility between users.
• The future behavior of owners, sitters, or third parties.
• The absolute accuracy of the information published by users.

Verifications, reviews, and badges are for informational purposes only and do not constitute guarantees.

LocalPets acts solely as a platform connecting users.

To the maximum extent permitted by applicable law, Miadels LLC and LocalPets shall not be liable for:

• Damages or losses related to a sit.
• Damage to homes, goods, or belongings.
• Illness, injury, accidents, or death of pets.
• Conflicts between owners and sitters.
• Sit cancellations.
• Direct or indirect economic losses arising from the use of the platform.
• Acts, omissions, or statements made by users.

Each user is responsible for evaluating for themselves the suitability of any agreement they reach with other community members.

LocalPets may modify, update, or remove platform functionalities at any time.

Likewise, these Terms and Conditions may be updated periodically to reflect legal, operational, or product changes.

When changes are significant, LocalPets may inform users through the platform or by email.

If the changes are significant, we will let you know by email or on the platform at least 15 days before they apply and ask you to accept the new version. If you do not agree, you can close your account at any time.

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of New Mexico, United States, without prejudice to conflict of law principles.

If you use LocalPets as a consumer and live in the European Union or in another country whose law guarantees it, you keep the protection of the mandatory rules of your country and may go to the courts where you live.

If any provision of these Terms is considered invalid or unenforceable, the remaining provisions shall remain fully in force.
